our land lord entered into a contract for deed on the house with us almost 3 years ago. we now found out that there was a joint tenant affidavit filed on the house with her and another party. the other partys name is nowhere in our contract. do we have any recorse…

Yet another reason that you should ALWAYS have a CFD drawn up by an experienced real estate attorney. It’s a bit late in the game, but you need one now.

It will not be a legal contract. A potential buyer can back out of the purchase. A purchase agreement must be signed by, The seller(s) whom ever name is on the deed, and the potential purchaser.
If the seller is now married and wasn’t when the bought the home, the new spouse must release dower in order to have clean and warrantable title to the property.
One often over looked law about purchase agreements, in order for them to be legal and binding, there must be an exchange of money. the purchaser must give a deposit. Whether or not it is refundable is optional. Good luck hope this helps
